ECSH83175 - Sanctions for non-compliance: prohibition on management: Imposing and issuing a prohibition on management

A prohibition on management can only be imposed and issued following a  of The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (MLR 2017) review.

Once the decision maker (DM) has identified that a prohibition on management is appropriate, the DM must issue a notice to the person under regulation 83 MLR 2017. This regulation specifies that the notice must contain:

  • The terms and the duration of the prohibition on management.
  • Clear written reasons for imposing the prohibition on management.
  • The right to a review under regulation 94 MLR 2017.
  • The right to appeal under regulation 99 MLR 2017.
